These Terms of Service (the “Terms”) are a binding agreement between you and Twist Labs, SIREN 807437645, located at 8 Bis Rue Abel, 75012 Paris, France, the operator of Cookping (“Cookping”, “we”, “us”). By creating an account, connecting an Instagram account, or otherwise using the service, you accept these Terms. If you do not agree with them, do not use Cookping.
1. What Cookping is
Cookping lets creators publish recipe pages and run Instagram comment-to-DM automations: you create a recipe or configure a link, attach it to one of your Instagram posts or Reels, pick a trigger keyword, and Cookping sends a direct message when a follower comments that keyword and Instagram's messaging rules allow it.
Cookping is a tool. You decide what content to publish, which links to send, which keywords to use, and which automations to activate. We provide the plumbing; you are the publisher and sender of everything that goes out through your account.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter a binding contract.
- You must provide accurate account information and keep your credentials confidential. You are responsible for all activity that happens under your account.
- You may only connect Instagram accounts that you own or are expressly authorized to operate.
3. Your content
“Your content” means everything you create or configure in Cookping: recipes (text, ingredients, steps, images), recipe pages, automation messages, button labels, trigger keywords, and any links or URLs you configure.
You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, display, and transmit your content solely as needed to operate the service — for example rendering your public recipe pages and delivering your automation messages.
You are solely responsible for your content. You represent and warrant that:
- you own or have all rights needed to publish and send your content, and it does not infringe any copyright, trademark, publicity, privacy, or other right of any person;
- your content is lawful, accurate, and not misleading or deceptive;
- any claims you make about food, nutrition, health, or diet comply with the laws that apply to you and your audience.
We do not review, verify, or endorse creator content, and we have no obligation to monitor it. We may nevertheless remove content or disable automations at any time if we believe they violate these Terms, the law, or third-party platform policies.
4. Recipes and food information
Recipes and food content on Cookping are provided by creators, not by us. We do not check recipes for accuracy, safety, allergens, nutrition claims, or dietary suitability. Creators are solely responsible for the recipes they publish, including ingredient accuracy, allergen disclosure, and food-safety instructions. Anyone who follows a recipe does so at their own risk. Nothing on Cookping is medical, nutritional, or professional advice.
5. Links you configure
Automations can send links — to your recipe pages or to any custom URL you choose. You are solely responsible for every link you configure and for the content of every destination it points to. We do not review, control, or endorse link destinations, and we are not responsible for them or for any harm they cause to you, your followers, or anyone else.
You must not configure links that point to destinations that:
- are illegal, or promote or facilitate illegal activity;
- distribute malware, or are used for phishing, scams, or fraud;
- are misleading about what the recipient will find there;
- contain content that is defamatory, hateful, sexually exploitative, or that infringes third-party rights;
- sell or promote regulated or age-restricted goods in a way that is unlawful for your audience.
We may disable any link or automation at any time, with or without notice.
6. Acceptable use of automations
You must not use Cookping to:
- create or run automations for any illegal purpose, or in any illegal manner;
- send spam, harassment, or messages recipients would not reasonably expect;
- deceive recipients, impersonate any person or brand, or misrepresent who is messaging them;
- violate Meta's terms and policies, or attempt to evade Instagram's messaging rules, rate limits, or consent requirements;
- collect or use follower data beyond what the service is designed to provide;
- probe, disrupt, or overload the service, or access it by any means other than the interfaces we provide;
- resell or white-label the service without our written agreement.
We may suspend or terminate accounts, automations, or content that we reasonably believe break these rules, without prior notice and without liability to you.
7. Instagram and other third-party services
Cookping depends on third-party platforms — above all Instagram and the Meta APIs — that we do not control. Cookping is not affiliated with, endorsed by, or sponsored by Meta or Instagram.
- Your use of Instagram through Cookping must comply with Meta's own terms and policies. You are responsible for that compliance.
- We do not guarantee that any message will be delivered. Instagram's rules (such as the 24-hour messaging window and consent requirements) can prevent delivery, and we deliberately skip sends that would break those rules.
- Meta may change or withdraw its APIs, or restrict or suspend your Instagram account, at any time. We are not responsible for any of that, and we may change or remove features to stay compliant with platform policies.
8. Plans, billing, and quotas
- Paid plans are billed as recurring subscriptions until you cancel. Cancellation takes effect at the end of the current billing period.
- Each plan has limits — such as monthly active contacts and the number of active automations. When you reach a limit, the related feature stops until the period resets or you upgrade.
- We may change plans and pricing. Price changes for an existing subscription take effect at the next renewal, with advance notice.
- Except where the law requires otherwise, fees are non-refundable, including for partial periods or unused quota.
9. Suspension and termination
You can stop using Cookping and delete your account at any time. We may suspend or terminate your access, or any automation or content, if you breach these Terms, if we are required to by law or by a platform we depend on, or if your use creates risk or possible legal exposure for us. Upon termination, your automations stop and your public pages may be taken down; sections of these Terms that by their nature should survive (including sections 3–5 and 10–12) survive termination.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT MESSAGES WILL BE DELIVERED, OR THAT ANY RESULTS (INCLUDING FOLLOWER GROWTH OR ENGAGEMENT) WILL BE ACHIEVED.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE — INCLUDING UNDELIVERED OR MISDELIVERED MESSAGES, ACTIONS TAKEN BY META OR INSTAGRAM AGAINST YOUR ACCOUNT, CREATOR CONTENT, OR LINK DESTINATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) FIFTY EUROS (€50).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for willful misconduct, gross negligence, or death or personal injury caused by our negligence, or mandatory consumer rights.
12. Indemnification
You will defend, indemnify, and hold harmless Cookping and its operator from and against any claims, damages, fines, and expenses (including reasonable legal fees) arising out of or related to: your content; the links and destinations you configure; the automations you run and the messages they send; your breach of these Terms or of applicable law; or your violation of Meta's or any other third party's terms or rights.
13. Changes to the service and to these terms
We may change, add, or remove features at any time, including to stay compliant with platform or legal requirements. We may also update these Terms; if a change is material, we will give reasonable advance notice (for example by email or an in-app notice). Continuing to use the service after a change takes effect means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by French law. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Paris, France. If you use the service as a consumer, this section does not deprive you of the protection of mandatory rules or competent courts of your country of residence.
15. General
- If any provision of these Terms is found unenforceable, the rest remains in effect.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or sale of assets.
- These Terms, together with the Privacy Policy, are the entire agreement between you and us about the service.
